Divorce is an issue that has been in place during the human history since marriage was formed, and has undergone changes over the history, which changes had different natures subject to different time and place. In fact, after advent of Islam, rules governing divorces underwent changes. That is, under Islam, the law governing divorce has been a confirmatory law rather than a constitutive law, and thus, the right to divorce has been confirmed by the Qur’an subject to conditions of the period and the place in which Islam emerged. Thus, it can perhaps be said that such right may change over time and in another place. For this reason, this paper aimed to consider the law governing divorce under Islam is a confirmatory law, and only discuss the reforms that the Qur’an introduced to vindicate and ensure women’s rights.
