According to Iranian Press Law, the Press Oversight Board is the responsible body for evaluation of the applications for publication license and determining the qualifications of the applicants and manger in charge of the publications.
The above mentioned board is also empowered to withdraw or revoke the license. Decision reached by this body is final, but this does not prevent an affected party to lodge complaint at legal courts against the ruling of the board. However, in case of dropping of charges or acquittal, is the license Issuing body liable to compensate the losses incurred by the applicant because of the decision made by the body or not?.
This paper is aimed at examining the civil responsibility of an entity above the jurisdictions of 3 branches of government and finding answer to the above stated question. The paper also evaluates the legal status of the Press Oversight Board, the nature of its rulings, its reference points, possibility and impossibility of indemnification, unlawful restrictions and enforcement of state sovereignty, formation question, parties to a legal case and the authority responsible to take up legal claims, an sample of a legal case demanding compensation.
